Pursuant to art. 13 of EU Regulation 2016/679, we inform you that your personal data - and the personal data that will subsequently be acquired as part of the management of the response to your request - will be processed, depending on the contact channel chosen, by DIVENTA SRL, with registered office in Via Donatello 36 20131 Milan (MI), email address privacy@diventa.eu for the following purposes:
a)follow up on your requests (e.g. information, test drives, assistance, complaints or other requests regarding the vehicles sold).
In order to respond to your request, DIVENTA may share, where necessary, your personal data with authorized LINKTOUR dealers and/or workshops within the DIVENTA network. They will process your data as independent data controllers, and will provide a specific privacy notice. DIVENTA may process your contact details collected through the form to contact you by telephone and complete your request.
b)carry out, subject to consent where required, remote commercial communications relating to the Company's products or services, as well as invitations and events organised by DIVENTA or by third-party companies with which we collaborate, using traditional or automated communication systems to the contact channels indicated directly by the interested parties, as well as other contact channels and social media relating to the interested parties otherwise identified;
c)define your profile through electronic processing, subject to your consent where required, or analyze your consumer habits and choices in order to propose personalized content, services, and products from the Company;
d)communicate, subject to your consent where applicable, your contact information to third parties operating in the automotive and related sectors, financial and insurance services (such as, for example, banks, leasing, factoring, finance companies, insurance companies, insurance and service agencies, real estate brokerage, finance, insurance, financial investments, and related services), transportation and distribution (such as electricity, water, gas, and related services supply and distribution companies), telecommunications and publishing, hotels, and similar establishments. These third parties, acting as independent data controllers, will process your contact information for information and promotional purposes regarding the products and services they market using both traditional and automated communication systems.
The legal basis for processing for the purposes referred to in subsection a) of the privacy policy is the performance of a contract or pre-contractual measures taken at your request pursuant to Article 6, paragraph 1, letter b) of EU Regulation 2016/679; the legal basis for processing for the purposes referred to in subsections b), c), and d) is your express consent pursuant to Article 6, paragraph 1, letter a) of the aforementioned Regulation.
Personal data will be processed by authorized persons and will be transmitted to service providers for activities strictly consistent with the pursuit of the indicated purposes. Furthermore, for the purposes referred to in point d), they will be communicated to entities belonging to the identified product sectors. For the indicated purposes, your personal data may be communicated to authorized dealers and/or workshops that are part of the DIVENTA SRL sales/service network.
Failure to provide the personal data requested for purpose a) prevents us from providing an adequate response. Failure to provide personal data not marked as necessary or failure to provide consent for purposes b), c), and d) only prevents us from sending promotional communications relating to the products and services marketed by the Company, including discounts, invitations to events, etc., commercial information in line with your interests, and from transferring your personal data to third parties operating in the identified product categories for their own promotional purposes.
Personal data will be retained for a period of time appropriate to the stated purposes of responding to requests, or until the interested party withdraws their consent and, in any case, in compliance with any more stringent time limits established by the data controller. Personal data that is no longer necessary, as it relates to the performance of activities that have already been completed, will not be further or otherwise used.
The processing of personal data for purpose c) will take place using both computerized and non-computerized methods. The personal data will be processed by classifying them to contribute to the production of lists of recipients of the data controller's commercial communications who are believed to be interested in a specific product/service.
We remind you that, as a data subject, you have the right to request from the data controller access to your personal data and its rectification or erasure, restriction of processing, or to object to its processing. As a data subject, you also have the right to withdraw your consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal. You also have the right to lodge a complaint with the Italian Data Protection Authority (Garante per la Protezione dei Dati Personali) pursuant to Article 77 of the Regulation, if you believe that the processing of your data violates the provisions of EU Regulation 2016/679, or to take appropriate legal action (Article 79 of the Regulation).
